Welcome to the1different. By visiting this site or buying something from us, you agree to the terms below. They're written in plain English on purpose.

1. Who we are

the1different is an apparel brand based in New York, selling through this website (the "Site"). Contact: support@the1different.com.

2. Orders and payment

When you place an order, you're making an offer to buy. We accept it when we email your order confirmation. Prices are in US dollars and may change without notice, but the price you see at checkout is the price you pay. Payment is processed securely by Shopify Payments and the wallets it supports (Shop Pay, Apple Pay, Google Pay). We may cancel or refuse an order if we suspect fraud, if an item is out of stock, or if there was a pricing or listing error, and we'll refund you in full if that happens.

3. Products

Our shirts are snow-washed, which means each one fades a little differently. Variations in the wash pattern are part of the product, not a defect. Colors on screen can differ slightly from the shirt in your hands. Sizing information is provided in good faith based on the manufacturer's measurements.

4. Shipping, returns, and refunds

Our Shipping Policy and Refund Policy are part of these terms.

5. Not medical advice

the1different makes clothing. Nothing on this Site, on our social media, or on our products is medical advice or a substitute for care from your own healthcare team.

6. Intellectual property

The the1different name, logo, designs, photographs, and site content belong to us. You're welcome to share photos of yourself in the shirt (please do). You may not reproduce, print, or sell our designs.

7. Your content

If you tag us or send us photos, reviews, or messages, you give us permission to share them on our site and social channels with credit to you. Tell us any time if you'd like something taken down and we will.

8. Limitation of liability

To the fullest extent permitted by law, the1different isn't liable for indirect, incidental, or consequential damages arising from your use of the Site or our products. Our total liability for any claim is limited to the amount you paid for the order in question.

9. Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

10. Changes

We may update these terms from time to time. The version posted on the Site when you place your order is the one that applies to that order.
